NOC

A No Objection Certificate (NOC) is a written declaration from an authority, employer, or sponsor stating it has no objection to a specific action by the bearer. In the UAE corporate context, an NOC is required from an existing employer when a residency holder wants to take on a second job (part-time work permit), join another company's shareholder register, sign as authorised signatory on another entity, or sometimes obtain certain government services.

NOCs are typically issued on letterhead, signed by the authorised signatory, and where required notarised. Standard turnaround is 1–3 working days from a clean request.

The process for obtaining a No Objection Certificate (NOC) typically involves the following steps:

1. Application: Submit a formal application to the relevant authority, which may be the employer, the Ministry of Human Resources and Emiratisation (MOHRE), or another designated agency.
2. Documentation: Provide required documentation, such as identification, employment contract, and other supporting documents as specified by the authority.
3. Review: The authority reviews the application and supporting documents.
4. Approval: If approved, the authority issues the NOC. The NOC is usually valid for a specific period.
5. Compliance: Ensure compliance with all applicable regulations and requirements during the NOC validity period.

For example, if an employee in Dubai with a mainland trade license wishes to join a new company, they will need to obtain an NOC from their current employer. Similarly, if a company with a mainland trade license wants to open a second branch office, an NOC from the existing company is required. In cases of employee transfer, the NOC ensures the employee's employment is not terminated prematurely and allows them to continue working for the new employer while maintaining their existing employment agreement. The NOC is a fundamental requirement for both individuals and businesses operating within the UAE.

An NOC is the document that unlocks parallel-track activities — second incomes, side licenses, or asset purchases — without breaching the primary sponsor relationship.
