What it is
Value Added Tax is a 5% federal indirect tax introduced in the UAE on 1 January 2018 under Federal Decree-Law No. 8 of 2017. It is administered by the Federal Tax Authority through EmaraTax and applies to most goods and services supplied in the UAE, with limited zero-rated and exempt categories (residential property after first sale, local passenger transport, certain financial services, exports outside the GCC implementing states, healthcare and education in defined cases).
A business must register for VAT once its taxable supplies and imports exceed the mandatory threshold of AED 375,000 in any rolling 12-month period. Voluntary registration is available from AED 187,500. Registered businesses charge VAT on sales (output VAT), claim back VAT paid on purchases (input VAT), and remit the net to the FTA, normally on a quarterly basis.
Failure to register on time is an AED 10,000 fine; failure to issue tax invoices, late filing, and late payment all carry their own administrative penalties — often the largest single source of FTA penalties on small UAE businesses.
Key characteristics
- Rate
- 5% on most supplies; 0% on exports and certain categories; exempt for some financial / residential supplies
- Mandatory threshold
- AED 375,000 in 12 months
- Voluntary threshold
- AED 187,500 in 12 months
- Filing cadence
- Quarterly (some large taxpayers monthly)
- Filing deadline
- 28 days after end of tax period
- Effective from
- 1 January 2018
How it works
- Track taxable supplies (sales + imports) on a rolling 12-month basis.
- Register on EmaraTax once the AED 375,000 mandatory threshold is breached or expected to be in 30 days.
- Issue compliant tax invoices showing the 5% VAT amount and your TRN.
- Maintain books and a VAT ledger under FTA bookkeeping rules for at least 5 years.
- File the VAT return on EmaraTax within 28 days of period-end and pay any net VAT due.
Types of VAT
| Type | Description | When it applies |
|---|---|---|
| Registration | The process of registering with the FTA for VAT. | Required for businesses with taxable turnover exceeding the threshold. |
| Compliance | Adhering to VAT regulations and reporting requirements. | Mandatory for all VAT-registered businesses. |
Examples
A consultancy invoicing AED 600,000/year is over the mandatory threshold and must register, charge 5% on UAE-resident clients, and file quarterly. A trading company exporting goods outside the GCC zero-rates the export but can still recover input VAT on local purchases.
Why it matters
VAT compliance is the most common compliance failure point for UAE SMEs. Late registration alone is AED 10,000; recurring filing/payment defaults can rapidly compound into six-figure penalties. Getting the systems right early is materially cheaper than catching up later.
Common misconceptions
Misconception
Free-zone companies don't pay UAE VAT.
Reality
Only Designated Zones for VAT (a specific list, distinct from the free-zone authority list) get special treatment. Most free-zone companies are inside the standard VAT regime.
Misconception
Service exports to non-UAE clients are VAT-free without paperwork.
Reality
Zero-rating an export of services requires evidence of the customer's place of residence and the place of supply rules — keep contracts and proof, or the FTA will reclassify on audit.
FAQs
- Do I have to register for VAT if I'm under AED 375,000?
- Not mandatorily. Voluntary registration is available from AED 187,500 and is sometimes useful for B2B businesses that want to recover input VAT on big setup spends. Most early-stage solo consultancies stay unregistered until they cross the mandatory threshold.
- How quickly does FTA issue a VAT TRN?
- Standard processing is 5–20 working days after a complete EmaraTax application. Files with missing trade-license documents, partial bank evidence, or unusual activity descriptors get delayed. Best Solution typically receives approvals in the lower end of that range.
- Can I deregister from VAT if my revenue drops?
- Yes. If taxable supplies fall below the voluntary threshold for 12 consecutive months, deregistration is mandatory; below the mandatory threshold but above voluntary, it is optional. Deregistration is filed on EmaraTax and must be completed within 20 business days of becoming required.
